1. Introduction
This manual is published in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 ("PAIA"). PAIA gives effect to the constitutional right of access to information held by the State and by private bodies where that information is required for the exercise or protection of any rights.
This manual is intended to help any person who wishes to request access to records held by Brown and Ferguson Advisory (Pty) Ltd ("the Company") to do so.

4. Guide by the Information Regulator
The Information Regulator has compiled a Guide, in terms of Section 10 of PAIA, containing information to assist a person wishing to exercise any right under the Act. The Guide is available from the Information Regulator:

5. Records Held by the Company
The Company holds the following broad categories of records. Not all records are automatically available; access is subject to the provisions of PAIA and applicable grounds for refusal.
Records relating to the Company itself:
- Statutory and company records (registration documents, resolutions, share register)
- Financial records, management accounts and tax records
- Insurance records
- Internal policies and procedures
Records relating to clients and engagements:
- Client engagement letters and correspondence
- Accounting, tax, audit, payroll and secretarial working papers and records
- Records provided to us by clients in the course of an engagement
Records relating to personnel:
- Employment records and contracts
- Payroll and related records
Records held under other legislation, including records kept in terms of the Companies Act 71 of 2008, the Tax Administration Act 28 of 2011, the Auditing Profession Act 26 of 2005, the Income Tax Act 58 of 1962, the Value-Added Tax Act 89 of 1991, the Basic Conditions of Employment Act, the Labour Relations Act, the Protection of Personal Information Act 4 of 2013, and other applicable legislation.
Access to client and personnel records is subject to confidentiality obligations and the grounds for refusal set out in PAIA.
6. How to Request Access
A request for access to a record must be made on the prescribed form (Form 2, the PAIA request form for private bodies) and submitted to the Information Officer at the address in section 3.
The request must:
- Provide sufficient detail to identify the record and the requester
- Identify the right the requester seeks to exercise or protect, and explain why the requested record is required to exercise or protect that right
- State the form of access required and how the requester wishes to be notified
- Where the request is made on behalf of another person, include proof of the capacity in which the requester is acting
7. Fees
PAIA provides for two types of fee: a request fee and an access fee. The Company may require payment of the prescribed request fee before processing a request, and an access fee (covering the cost of reproduction, search and preparation) before granting access. The applicable fees are those prescribed in the regulations to PAIA and are available from the Information Officer on request.
8. Grounds for Refusal
The Company may refuse a request for access on any of the grounds for refusal set out in Chapter 4 of Part 3 of PAIA, including the mandatory protection of the privacy of third parties, the commercial information of third parties, confidential information, and legally privileged records.
9. Remedies
A requester who is dissatisfied with a decision of the Information Officer may:
- Lodge a complaint with the Information Regulator, or
- Apply to a court for appropriate relief,
in accordance with PAIA.
